If you continue to browse and use this website or place an order with us you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern Mike O’Dwyer Limited Online relationship with you in relation to this website.
The term “Mike O’Dwyer Limited Online” or “us” or “we” refers to the owner of the website. The term “you” refers to the user or viewer of our website.
The use of this website is subject to the following terms of use:
1. Risk and Title
The Products will be at your risk from the exact time of delivery.
Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products, including delivery charges.
2. Pricing
Most prices include free delivery to UK mainland, excluding the Highlands of Scotland, however we are unable to deliver certain items to Scotland free of charge, if there is an issue with an order that has been placed relating to a delivery in Scotland we will contact you within 48 hours and give you the option to pay the extra delivery charge or cancel the order. We always try our best to deliver for FREE. Certain items will have a minimum order quantity to qualify for free delivery. This will be stated in the product information. Although every effort is made to ensure the prices stated in the website are correct, should an error on price occur, and an order is placed, you will be informed and given the option of continuing the order at the correct price or cancelling the order. All prices are subject to VAT, which will be automatically added at the checkout.
3. Payment:
3.1 Payment is required with order unless credit terms have been agreed.
3.2 If a credit account has been agreed then payment terms for the first order will be upon delivery, for any subsequent orders Mike O'Dwyer Limited credit terms of payment are 30 days from date of invoice.
3.3 All payments should be made in sterling in accordance with our agreed terms.
3.4 If in default we reserve the right to charge interest on overdue accounts at a rate of 2.5% per month or part thereof.
3.5 We reserve the right to withhold despatch of orders if the account is in arrears.
4. Delivery:
4.1 Any lead times Quoted on our site are approximate guides only. Times quoted are so quoted in good faith but shall be non-binding.
4.2 To facilitate a prompt delivery all despatches will be made direct from the point of manufacture.
4.3 We shall not be liable for any losses incurred by you or any other person as a result of any delay in the delivery of the goods or any part of the order for any reason whatsoever.
4.4 The due performance of the contract is subject to cancellation or such variation as the seller may find necessary as the result of instructions or lack of instructions from the buyer, or as a result of industrial dispute or of any cause whatsoever beyond the seller’s reasonable control.
4.5 We reserve the right to make partial deliveries.
4.6 Deliveries will be carried out directly by the Manufacturers or Manufacturers own courier. We are unable to deliver certain items to Scotland free of charge, if there is an issue with an order that has been placed relating to a delivery in Scotland we will contact you within 48 hours and give you the option to pay the extra delivery charge or cancel the order. Certain items will have a minimum order quantity to qualify for free delivery, this will be stated in the product information.
4.7 Deliveries will only be made Monday to Friday between 0800 hours to 1800 hours. We are uable to specify exact delivery times. After your order has been processed you will be advised of a delivery date, our logistics department will then call you 48 hours prior to your delivery to book this in. For next working day delivery items that are ordered before 3pm these will be delivered on the next working day without notification. If a Next day delivery item is out of stock we will inform you ASAP with a stock due date and give you the option to cancel the order or wait for the item/s to come back into stock.
4.8 All deliveries are Kerbside, ground floor or goods inwards, tailgate only unless specific instructions have been agreed prior to an order being placed.
4.9 If there are any parking restrictions whatsoever at you premises you must inform us of this before placing any orders with us. Failure to inform us of any restrictions or special requests could result in the items being returned and a re delivery charge would apply.
4.10 A signature is always required for any item delivered. If there is no authorised persons available to sign for the delivery a re-delivery charge will apply
4.11 For deliveries to private addresses a charge may be applicable if the manufacturers vehicles are unable to gain direct access to the specified delivery Address, or if there are any parking restrictions in such cases a separate courier company with smaller vehicles will be used. Our transport team will notify you of any delivery problems along with any extra costs, you will have the option to pay the charge or receive a refund. Any charges must be paid for in full before delivery can take place. We will always do our best to deliver to private Address for free.
5. Damages:
5.1 All goods should be inspected immediately while the delivery driver is still present. If found to be faulty, please write "Refused due to damage" on the consignment note and hand the goods back to the driver.
5.2 If it is not possible to inspect goods whilst the driver is present, damages must then be reported via email within twenty four hours following delivery along with images of the damage. Any missing components must be reported within five working days. If any items are being stored, not required for immediate use or are not being built up straight away they still need to be checked / inspected within this timeframe.
5.3 Claims for damages or missing items can not be entertained if damages or missing items are reported outside of the stated times above.
5.4 Credit shall not be given for goods received damaged, our manufacturers will repair or replace these items.
6. Returns:
If non faulty goods are returned it will be subject to the following conditions:
6.1 It is the buyers responsibility to return all non faulty products. The buyer shall unless otherwise stated be responsible for the cost of the return.
6.2 Goods must be returned to their point of manufacture.
6.3 Goods must be returned in their original packaging, unused, unassembled and in a resaleable condition.
6.4 All items must be returned within 7 days of the delivery date.
6.5 A handling and re stocking charge of 30% of the invoiced value plus the carriage cost both ways will be levied. There will be an additional charge for re-boxing if the original packaging is not in a suitable condition for re-stocking.
6.6 All items shall be at the risk of the buyer until actual receipt of the goods is with Mike O'Dwyer Limited. Proof of return delivery will remain with the buyer.
6.7 We reserve the right to charge for incomplete returns.
6.8 Made-to-order items and items in a tailor made Colour cannot be accepted back in to stock. If you decided to cancel your made-to-order product for any reason prior to them being delivered, it is unlikely that we could sell it to another customer at full selling price. Mike O’Dwyer Limited Online will therefore charge a cancellation fee of 30% of the order price - this applies to all orders when the order is cancelled after 24 hours of placing the order prior to delivery. Made to order products which includes tailor made fabric choices cannot be returned after delivery.
6.9 The above conditions do not affect your statutory rights when goods are faulty, or not as described.
7. Guarantee
All products supplied by Mike O’Dwyer Limited Online come with a Manufacturers Guarantee. Please refer to the features section on specific items for the length of Guarantee. The guarantee is effective from the date of supply. We reserve the right not to apply the guarantee in cases of inappropriate use or where a product has been tampered with by a third party or interventions by non-authorised personnel. Except as herein expressly provided and as provided by law, we do not supply goods with the benefit of any term, warranty or condition, express or implied, as to the merchantability of the goods or their suitability for any purpose whatsoever. Goods subjected to unfair wear and tear, misuse, defective maintenance, alteration or modification, are excluded from this guarantee.
8. Retention of ownership
Property of the goods remains with Mike O’Dwyer Limited Online until full payment has been received by us. Until full payment is received we may at any time recover the goods and may enter the buyer’s premises for this purpose. Nevertheless the risk in the goods passes to the buyer on delivery and the buyer shall promptly effect and maintain in the joint names of the parties, insurance of the goods against loss or damage in their full invoice price until final payment.
9. Quotations
All Quotations provided are valid for a period of 30 days only.
10. Samples
Some manufacturers will provide samples if required. It is reasonable to accept all samples to be returned in the same good condition they arrive with you.
All samples must be available for collection from the same Address they where delivered to within 14 days from the delivery date. All samples remain your responsibility from the time they are delivered until they are collected.
You must sign for all samples on delivery and check them over to ensure they are free from damages, once signed for it is deemed all samples have been delivered in fine condition free from any damage. You will be required to sign for the samples on collection and where there are multiple samples from different manufacturers you must only allow the driver to collect samples listed on their specific paperwork, failure to comply with this could result in you being charged full price for the samples.
